Introduction

These Terms of Use (“Terms”) govern your access to and use of the Budelo platform, including the Budelo mobile application, website, and any related services (collectively, the “Services”). The Services are operated by Budelo Ltd (“Budelo”, “we”, “our”, or “us”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

About Budelo

Budelo is a business-focused platform designed to support sole traders and small businesses operating within the United Kingdom. The Services are intended strictly for business and professional use and are not provided for personal or consumer use. By using the Services, you confirm that you are at least 18 years old and that the information you provide to us is accurate and up to date.

User Accounts

In order to access certain functionality, you may be required to create an account using an email address and password. You are responsible for maintaining the confidentiality and security of your account credentials and for all activities carried out under your account. You must notify us immediately if you believe your account has been accessed or used without authorisation.

Payments & Platform Fees

Budelo provides functionality that allows users to create and send payment links to their own customers using payment processing services provided by [Stripe](https://stripe.com/gb?utm_source=chatgpt.com). Where a payment is successfully processed through a Budelo-generated payment link, Stripe may charge its own processing fees and Budelo Ltd will charge a platform fee equal to 3% of the transaction value plus applicable VAT. These fees are charged in exchange for facilitating the transaction and providing associated platform services.

Refunds

All Budelo platform fees are non-refundable. This remains the case even where a payment is later refunded to a customer, where a chargeback or dispute occurs, or where the underlying service, booking, or job is cancelled. The Budelo fee relates to the facilitation of the original transaction and associated platform functionality rather than the outcome of any agreement between you and your customer.

Stripe Services

Payment processing services are provided by Stripe and may be subject to additional Stripe terms, policies, verification procedures, and connected account requirements. Budelo is not responsible for the operation, availability, actions, or decisions of Stripe, including payment delays, account suspensions, or payment processing failures.

User Content & Business Data

You retain ownership of any information or content you upload, submit, or store within the Services, including customer information, schedules, notes, logos, and other business-related materials. By using the Services, you grant Budelo Ltd a limited licence to host, store, process, and display such content solely for the purpose of operating, maintaining, and improving the Services.

You remain solely responsible for the legality, accuracy, and appropriateness of your content and for ensuring that you have all necessary permissions and legal bases required to store or process customer information.

Acceptable Use

You agree not to misuse the Services or use them for unlawful purposes. This includes, but is not limited to, engaging in fraudulent activity, interfering with platform security, attempting unauthorised access to systems or accounts, reverse engineering the platform, distributing malicious software, misusing payment systems, spamming users, or using the Services in a manner that could harm Budelo, its users, or third parties.

We reserve the right to investigate suspected misuse and take any action we reasonably consider necessary.

Service Availability

While we aim to provide a reliable and continuously improving service, we do not guarantee uninterrupted access to the Services. The Services may occasionally be unavailable due to maintenance, updates, technical issues, third-party outages, or events beyond our reasonable control.

We may modify, suspend, discontinue, or remove features or functionality at any time without liability.

Beta Features & Future Changes

From time to time, we may release beta, experimental, or early-access features. Such features may be incomplete, contain errors, or change significantly over time. Budelo reserves the right to modify or remove beta functionality at any time without notice.

Data & Backups

Although we take reasonable technical and organisational measures to help protect user data, you remain responsible for maintaining backups and copies of important information stored within the Services.

Budelo may provide export or download functionality to assist users in maintaining their own records, and users are encouraged to back up their data regularly.

Notifications & Device Permissions

The Budelo app may request access to certain device features, including notifications, contacts, location services, and biometric authentication such as fingerprint or facial recognition login. These permissions are optional and can usually be managed through your device settings.

Budelo does not store or process biometric data directly.

Intellectual Property

All intellectual property rights in the Services, including software, branding, design, content, and related materials, remain the property of Budelo Ltd or its licensors. These Terms grant you a limited right to use the Services but do not transfer ownership of any intellectual property.

Suspension & Termination

Budelo may suspend or terminate access to the Services where we reasonably believe that these Terms have been breached, where fees remain unpaid, where fraudulent or illegal activity is suspected, where the platform is being abused, or where continued access may create legal, operational, or security risks.

We may also temporarily suspend accounts during investigations.

Limitation of Liability

To the fullest extent permitted by law, Budelo Ltd shall not be liable for any indirect, incidental, consequential, or special losses arising from or related to the use of the Services, including loss of profits, revenue, business opportunities, data, or business interruption.

The Services are provided on an “as available” and “as is” basis without guarantees that they will always be uninterrupted, secure, error-free, or suitable for every business purpose.

Nothing in these Terms excludes liability that cannot legally be excluded under the laws of England and Wales.

Third-Party Services

The Services may rely on third-party providers for functionality including hosting, payment processing, mapping, address lookup, and email delivery. Budelo is not responsible for failures, outages, or actions taken by such third-party providers.

Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how personal information is collected, used, and protected.

Changes to These Terms

We may update these Terms from time to time. Where changes are significant, we may provide notice through the app, website, or email.

Continued use of the Services after updated Terms become effective constitutes acceptance of those changes.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
